Litigation of Business Related Constitutional and Federal Claims
Constitutional claims involving the 1stAmendment, the 4th Amendment, and the 14th Amendment may be implicated by government action. These types of lawsuits frequently include a claim for attorney’s fees under 42 U.S.C. §1983 and 42 U.S.C. §1988.
For instance, we’ve represented a municipality that denied a license to a tattoo establishment and sued for violation of the 1st Amendment (we won). We successfully defended a municipality that enacted several ordinances challenged on constitutional grounds; litigated through settlement (2 weeks before trial) claims against a municipality on violations of federal law; and litigated adverse zoning decisions on constitutional grounds and the Fair Housing Act and the Americans with Disabilities Act.
