Other business and commercial litigation we handle include real estate litigation which may involve boundary disputes, mechanic’s liens, damage to real property and inverse condemnation. Constitutional claims involving the 1stAmendment, the 4th Amendment and the 14th Amendment may be implicated by government action. These types of lawsuits frequently include a claim for attorney’s fees under 42 U.S.C. §1983 and 42 U.S.C. §1988. For instance, we’ve represented a municipality that denied a license to a tattoo establishment and sued for violation of the 1st Amendment (we won). In some instances, adverse zoning decisions can implicate a constitutional or statutory prohibition. For example, the Fair Housing Act and the Americans with Disabilities Act may provide a cause of action for improperly denied zoning applications for certain businesses that provide services to people protected by these laws. We represent clients in claims for injunctive relief including temporary injunctions and permanent injunctions to prohibit certain activities that breach a contract or law or local ordinance
