Commercial Insurance Disputes and Denials
In Colorado, courts interpret insurance policy terms using their fair, natural, and reasonable meaning. In addition, coverage provisions are construed in favor of the insured to provide the broadest possible coverage. Most policies will include a duty to defend the insured against a lawsuit if the claims alleged in the complaint, if proven, would be covered under the policy. Ambiguities in insurance policies are construed against the insurer and in favor of coverage.
Damages
Damages for wrongful denial or unreasonable delay of claims can result in damage of two times the covered benefit plus attorney’s fees and costs.
